EXPO2025Personal Agent

Terms of Use

These Terms of Use define the terms and conditions for the use of the EXPO 2025 Personal Agent smartphone app (hereinafter referred to as the "App"), jointly provided by NTT Urban Solutions, Inc. and NTT DATA Japan Corporation (hereinafter collectively referred to as the "App Providers"). All users of this App must carefully review these Terms of Use before using the App and agree to all terms and conditions. Use of the App by a user is deemed acceptance of the Terms of Use.

Article 1. Use of this App

  1. The details of the App and its use are provided in the App. The terms and conditions of use of the App provided by the App Providers in the App are a part of these Terms of Use. In the event of any conflict between these Terms of Use and the terms and conditions provided by the App Providers, these Terms of Use will take precedence unless otherwise stated in the terms and conditions.
  2. A user who is a minor, an adult ward, or a person under curatorship or assistance may not use this App without the prior consent of their legal representative.
  3. Users can use this App in conjunction with related services (hereinafter referred to as the "Related Services") provided by the Japan Association for the 2025 World Exposition (hereinafter referred to as the "Association") by logging in using an Expo ID, a common ID provided by the Association.
  4. Use of the Expo ID is subject to its Terms of Service, which are provided separately by the Association. Users' use of Related Services is subject to the terms and conditions of the Related Services, which are provided separately by the Association.
  5. The App Providers are not liable for any damages incurred by the user as a result of the user's use of the Related Services, except in cases of intentional or negligent conduct on the part of the App Providers.

Article 2. Notification to Users

Notifications from the App Providers to users regarding the App will be made through the App or other methods determined by the App Providers, and such notifications will be deemed to have been received by users at the time they should normally have been received by the users.

Article 3. Intellectual Property Rights

  1. The App Providers or third parties with legitimate rights retain all intellectual property rights, including but not limited to copyrights, trademarks, image rights, and publicity rights, with respect to the App and all content provided through the App, such as text, images, video, and music (hereinafter referred to as "Content").
  2. Users must not translate, edit, modify, or otherwise use, or permit any third party to use or publish, the Content beyond the scope specified in the Copyright Act and other laws and regulations without the permission of the App Providers and the third party specified in the preceding paragraph.
  3. If a user posts Content on the App (hereinafter referred to as "Posted Content"), the user or any other third party who created such Posted Content retains the intellectual property rights to the Posted Content.
  4. Users must grant App Providers permission to use the Posted Content for the following purposes without compensation.
    1. To provide the App to users
    2. To review actions that violate these Terms of Use
    3. To promote the App
    4. To maintain and improve the App
    5. To be used in the planning, management, and new development of the App
    6. To serve any other purpose incidental to the preceding items
  5. Users agree not to exercise the moral rights of authors with respect to the use and application by App Providers as provided in the preceding paragraph.
  6. If the Posted Content infringes the rights of a third party other than the user, the user must obtain the consent of the third party before posting the relevant Posted Content.
  7. The Posted Content must not contain any of the following.
    1. Anything that damages the reputation or credibility of the App Providers, the Association, or other users
    2. Anything that promotes discrimination, prejudice, racism, hatred, harassment, or human rights abuse against an individual or group
    3. Anything that directly depicts sexually provocative behavior
    4. Anything that is violent or threatening or encourages others to engage in violent or threatening behavior
    5. Anything that infringes the intellectual property rights, image rights, privacy rights, or any other rights of a third party
    6. Anything that contains a computer virus
    7. Anything that violates social norms and public morality
    8. Anything that violates or encourages the violation of laws and regulations
    9. Anything that the App Providers deem to be inappropriate, based on reasonable grounds, in light of the purpose of the App, in addition to the preceding items
  8. The App Providers reserve the right to modify, cut, or otherwise alter the Posted Content to the extent necessary for the smooth provision of the App, system development/improvement/maintenance, and other purposes.
  9. The App Providers reserve the right to delete, without prior notice, any Posted Content if they determine, based on reasonable grounds, that such Posted Content violates Paragraphs 6 or 7 of this Article or any other provision of these Terms of Use.

Article 4. Prohibited Actions

In using the App, users must not engage in any of the following:

  1. Actions that violate or may violate these Terms of Use
  2. Actions that violate or encourage the violation of any law, court order, ruling, or decree, or any legally binding governmental regulation
  3. Fraudulent or threatening actions against the App Providers, other users, or third parties
  4. Actions that disparage the App Providers, other users, or third parties
  5. Actions related to criminal activity
  6. Actions that violate social norms and public morality
  7. Actions that infringe or violate the intellectual property rights, trade secrets, shared data with limited access, image rights, publicity rights, privacy, reputation, or other rights or interests of the App Providers, other users, or third parties (including actions that directly or indirectly cause such infringement or violation)
  8. Actions that damage or may damage confidence in the App Providers or the App
  9. Actions that interfere with or disrupt the administration of the App or related networks, systems, etc.
  10. Actions that take advantage of bugs or malfunctions in the App
  11. Illegal or improper viewing, collection, aggregation, modification, disclosure, or other similar actions regarding other users' Expo IDs, personal information, or other data
  12. Actions such as using or obtaining another user's Expo ID to impersonate that user or to falsely imply a relationship with that user
  13. Actions to reverse assemble, reverse compile, or reverse engineer the App or Content
  14. Actions that the App Providers deem to be inappropriate, based on reasonable grounds, in light of the purpose of the App, in addition to the preceding items

Article 5. Devices and Mobile Communications Lines

  1. Users are responsible for obtaining and maintaining, at their own expense, the devices and mobile communications lines used to connect to the App.
  2. Users are responsible for all communication costs incurred while using the App.

Article 6. Personal Information

App Providers will handle any personal information obtained from users in connection with the use of the App in accordance with the Privacy Policy.

Article 7. Suspension of Use of the App and Termination of Contract

If any of the following apply to a user, the App Providers reserve the right to suspend the user's use of the App, in whole or in part, or to terminate the contract for the use of the App, in whole or in part, without prior notice.

  1. If any of the provisions of these Terms of Use are breached
  2. If the App Providers deem it necessary to suspend use or terminate the contract on reasonable grounds

Article 8. Changes, Suspension, and Termination of the App

The App Providers reserve the right to change, suspend, discontinue, or terminate the App or the Content, in whole or in part, at any time, for any reason, without prior notice. For example, the App Providers may temporarily suspend the App, in whole or in part, without prior notice to users, in any of the following cases.

  1. If it becomes difficult to provide App services due to natural disasters such as earthquakes, fires, floods, and tsunamis, wars, insurrections, acts of terrorism, riots, and other disturbances
  2. If the server, communication lines, or other equipment used to provide App services becomes unavailable due to a malfunction, failure, power outage, etc.
  3. In the event of routine or emergency maintenance, inspection, repair, or modification of the system used to provide App services
  4. When requested pursuant to a legal statute or decision of a judicial or administrative body
  5. If the App Providers deem it necessary for other reasons related to the operation or technical aspects of the App, based on reasonable grounds

Article 9. No Warranty

  1. The App Providers do not warrant that the App will meet a user's specific purpose or achieve a particular result.
  2. The App Providers do not warrant that the App can be used as intended outside of Japan.
  3. The App Providers do not warrant that the App will function properly on a user's device and are under no obligation to test or make improvements to provide such a warranty.
  4. The App Providers do not warrant in any way the completeness, accuracy, legality, or usefulness of the App or the Content, nor the accuracy, adequacy, legality, usefulness, or any other matter of the information obtained through the use of the App or the Content.
  5. The App Providers do not warrant that there will be no slowdowns in the display speed or failures of the App due to heavy access to the App or other unforeseen causes. The App is provided "as is," and the App Providers do not warrant that it will be free of bugs, malfunctions, or security defects.
  6. The App Providers do not warrant that use of the App will not be suspended or that there will be no modification, interruption, suspension, or termination of the App or the Content.
  7. This App and the information provided through the App contain words and images generated by generative AI (hereinafter referred to as "Generated Material"). The App Providers do not warrant the completeness, accuracy, legality, usefulness, or lack of fairness bias of the Generated Material or that the use of the Generated Material will not infringe the rights of any third party. The App Providers will not use personal or confidential information to provide instructions to generative AIs.

Article 10. Indemnification and Limitation of Damages

  1. The App Providers are liable for the App only to the limited extent set forth in the applicable provisions of these Terms of Use. The App Providers are not liable for matters that are not warranted, for matters for which they are not deemed liable, or for matters for which users are deemed liable under the applicable provisions of these Terms of Use, except in the case of willful misconduct or negligence on the part of the App Providers.
  2. If a user suffers damages in connection with the use of this App due to a breach of duty or tort by the App Providers, the App Providers are liable for compensation only for the direct and ordinary damages actually suffered by the user, except in cases of intent or gross negligence on the part of the App Providers.

Article 11. Force Majeure

    In the event that the provision of the App is prevented by any natural disaster (including, but not limited to, typhoon, tsunami, earthquake, storm, flood, lightning, and salt damage), fire, infectious disease, epidemic, cyberattack, pollution, war, riot, insurrection, act of terrorism, strike, enactment, amendment, or repeal of any law, regulation, order, or decree by any governmental authority, other governmental actions, labor dispute, transportation accident, failure of communication lines, or other force majeure, the App Providers are not liable for any damages or inconvenience suffered by any user of this App.

Article 12. Suspension and Compensation for Damages

If a user engages in behavior that violates these Terms of Use, the App Providers reserve the right to take action to suspend such behavior. If any damage is caused to the App Providers or any third party as a result of such behavior, the user will be liable to compensate for such damage.

Article 13. Non-transferability of Rights and Obligations

Users of this App must not, without the prior written consent of the App Providers, transfer to or inherit from a third party any of their rights and obligations under these Terms of Use or transfer to or inherit from a third party any or all of their rights and obligations or responsibilities under these Terms of Use, or offer as security any of their rights and obligations or responsibilities under these Terms of Use.

Article 14. Confidentiality

Users must maintain strict and appropriate control over any confidential information of the App Providers that they obtain through the use of the App and must not disclose, provide, or leak such information to any third party or use it for any purpose other than the use of the App without the prior written consent of the App Providers.

Article 15. Exclusion of Anti-social Forces

  1. Users must declare that they are not currently a boryokudan crime syndicate, a member of a boryokudan crime syndicate, a former member of a boryokudan crime syndicate who has been out of the syndicate for less than five years, an associate member of a boryokudan crime syndicate, a boryokudan affiliated company, a sokaiya racketeer group, a group engaging in criminal activities under the pretext of conducting social campaigns, a crime group specialized in intellectual crimes, or any other similar group (hereinafter referred to as "Anti-social Forces"), and must also declare that they do not belong to any of the following categories and agree that they will not belong to any of these categories in the future.
    1. Have a relationship with an organization whose management is known to be controlled by, or significantly involved with, Anti-social Forces, or any other person equivalent to such an organization
    2. Have a relationship that is considered an improper use of Anti-social Forces, such as for the purpose of making an illegal profit for oneself or a third party or for the purpose of causing harm to a third party
    3. Have a relationship that is perceived to involve providing funds or favors to Anti-social Forces
    4. A member of the board of directors or a person substantially involved in the management of an organization having a relationship with Anti-social Forces that is considered socially reprehensible
  2. Users must agree that they will not, and will not permit any third party to, do any of the following.
    1. Violent acts of demand
    2. Unreasonable demands beyond legal responsibility
    3. Threatening language or actions or use of violence
    4. Spreading rumors or using deceptive means or force to defame the other party's credibility or obstruct the other party's business
    5. Other acts similar to the preceding items

Article 16. Changes to the Terms of Use

The App Providers reserve the right to change the Terms of Use if they deem it necessary in accordance with applicable laws and regulations. In the event of any such changes, the App Providers must publicly post the revised Terms of Use, such as by posting the revised Terms of Use on the App, and the revised Terms of Use will be effective as of the revised Terms of Use enforcement date specified at the time of such posting.

Article 17. Export Controls

  1. In using the App and the technologies used in the App, users must acknowledge that the App and the technologies may be subject to export controls under the Foreign Exchange and Foreign Trade Act and other export-related laws and regulations in Japan and the U.S. Export Administration Regulations (EAR), and may be subject to export controls in other countries, and must comply with such laws and regulations.
  2. Users must not transfer, export, or re-export the App or the technologies used in the App to entities, residents, or citizens of embargoed or trade-sanctioned countries, or to prohibited persons or entities, without proper government authorization.
  3. Users must not use the App or the technologies used in the App for the development, production, or use of weapons of mass destruction, including nuclear weapons or conventional weapons, as defined in the Foreign Exchange and Foreign Trade Act and other export-related laws and regulations in Japan.

Article 18. Severability

If any provision of these Terms of Use is held to be invalid or illegal, the remaining provisions of these Terms of Use will remain in full force and effect.

Article 19. Applicable Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of Japan. The Tokyo Summary Court or the Tokyo District Court, depending on the nature of the dispute, will have exclusive jurisdiction in the first instance over any dispute arising between a user and the App Providers in connection with this App.

Article 20. Consultation

If a dispute arises between a user and the App Providers regarding any matter not covered by these Terms of Use or the interpretation of these Terms of Use, the user and the App Providers will promptly resolve such dispute through mutual consultation in accordance with the principle of good faith.
